In a hearing held on September 19, 2024, the New Hampshire Ballot Law Commission voted 4-1 to reject the Democratic Party's effort to deny ballot access to Green Party presidential candidate Dr. Jill Stein.
CCD and More Voter Choice represented Dr. Stein.
Democratic Party activist John Tackeff, who filed the Democrats' challenge, claimed Dr. Stein's petitions fell short of the 3,000-signature requirement because some signatures -- although otherwise valid -- did not include the voter's ward number.
Under New Hampshire law, Dr. Stein was required to submit petitions signed by 1,500 voters from each of the state's two congressional districts. There was no dispute that Dr. Stein complied with that requirement.
But Tackeff claimed Dr. Stein should be disqualified because some signatures on her petitions did not include the ward number.
As CCD argued at the hearing, and as New Hampshire Secretary of State David Scanlan agreed, elections officials were able to verify the signatures without the ward numbers, and furthermore, the state has no interest in requiring voters' ward numbers on a petition for a candidate for President, because a voter's ward number is not relevant when a candidate runs for statewide office.
Tackeff was represented at the hearing by three attorneys from the Elias Law Group, which was spearheading the Democratic Party's effort to deny voters the choice of voting for Dr. Stein or any other Independent or Minor Party candidate in multiple states nationwide.
The New Hampshire Ballot Law Commission's ruling was the latest in a string of losses CCD and More Voter Choice dealt Democrats seeking to suppress voter choice in battleground states including Wisconsin, two lawsuits in North Carolina, and two more in Georgia.
